Limitation of Liability

To the maximum extent permitted by applicable law, SKOMITE and its service providers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

  • Your use or inability to use our services
  • Any unauthorized access to or use of our servers and/or any personal information stored therein
  • Any interruption or cessation of transmission to or from our services
  • Any bugs, viruses, trojan horses, or the like that may be transmitted to or through our services
  • Any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the services
  • Client-side data misuse, security breaches caused by user negligence, or unauthorized access due to compromised user credentials

Our total liability for any claims arising out of or relating to the use of our services shall not exceed the amount paid by you to SKOMITE in the twelve (12) months preceding the claim.

Governing Law

These Privacy Policy and Terms of Service shall be governed by and construed in accordance with the laws of Nepal, without regard to its conflict of law provisions. Any disputes arising out of or relating to these terms or the use of SKOMITE services shall be subject to the exclusive jurisdiction of the courts of Nepal.

By using SKOMITE, you agree that any legal action or proceeding arising out of or relating to these terms shall be brought exclusively in the competent courts of Nepal.

Billing and Payment

5.1 Fees

Users agree to pay all applicable fees for the use of SKOMITE services as specified in their service agreement or subscription plan. Fees are charged according to the selected plan and billing cycle. All fees are non-refundable unless otherwise stated in the service agreement.

5.2 Payment Information

Users must provide accurate, current, and complete billing information and update it as necessary. Users are responsible for maintaining the security of their payment information and for all charges incurred under their account.

Termination

6.1 Termination by SKOMITE

We reserve the right to terminate or suspend access to our platform immediately, without prior notice or liability, for any reason including but not limited to:

  • Data security breaches caused by client negligence or misuse
  • Violation of these Terms of Service or Privacy Policy
  • Unauthorized access or use of the platform
  • Failure to pay applicable fees
  • Any activity that may harm, disrupt, or compromise the security or integrity of our services

Upon termination, your right to use the services will immediately cease. We may delete or deactivate your account and all associated data at our discretion.

6.2 Termination by User

Users may terminate their use of SKOMITE services at any time. Specific termination procedures, notice requirements, and any applicable fees or refunds will be discussed and agreed upon at the time of contract signing. Users are responsible for exporting their data before termination if they wish to retain it.

Agreement to Terms

By using SKOMITE, you acknowledge that you have read, understood, and agree to be bound by these Privacy Policy and Terms of Service. If you do not agree to these terms, you must not use our services.
